AI Services — Supplemental Terms & Conditions

These Supplemental Terms & Conditions apply to the features or functionalities, provided by or on behalf of SRAM, LLC and its subsidiaries and affiliates worldwide (collectively “SRAM”, “we”, “us” or “our”) that incorporate, use, depend on, or employ any machine learning, deep learning, and other artificial intelligence technologies, including any such technologies capable of generating content based on user-supplied prompts, such as SRAM’s compatibility AI chatbot (collectively, the “AI Services”).

By using the AI Services, you signify your agreement to these Supplemental Terms & Conditions. If you do not agree with these terms, please do not use the AI Services. We reserve the right, at our discretion, to change, modify, add, or remove portions of these terms at any time. Your continued use of the AI Services following changes to these terms will signify your acceptance of the revised terms.

These Supplemental Terms & Conditions are in addition to, and form a part of, the Global Privacy Policy and Website Terms of Use located at https://www.sram.com/en/company/legal, both of which are incorporated herein by reference. In the event of a conflict between these Supplemental Terms & Conditions and any other terms in the Global Privacy Policy or Website Terms of Use, these Supplemental Terms & Conditions control solely with respect to the AI Services.

SRAM’s AI SERVICES GENERATE CONTENT AND RESPONSES USING MACHINE LEARNING MODELS. THESE OUTPUTS ARE AUTOMATED AND NOT SUBJECT TO HUMAN REVIEW. DUE TO THE NATURE OF THE AI SERVICES AND AI TECHNOLOGY, OUTPUT MAY INCLUDE INACCURACIES, OUTDATED INFORMATION, OR BIASES. THE AI SERVICES SHALL NOT BIND SRAM IN ANY WAY. ANY REPRESENTATIONS ABOUT PRODUCTS, FEATURES, CAPABILITIES, COMPATIBILITIES, OR PRICING PROVIDED BY THE AI SERVICES MAY NOT BE ACCURATE AND SHOULD NOT BE RELIED UPON AS DEFINITIVE OR OFFICIAL.

1. What the AI Services Do

SRAM’s AI Services are intended to generate outputs that help you find components that may be compatible with your bike based on your inputs into the AI Services.

Output includes any information, data, materials, text, images, code, works, or other content that is generated by or otherwise output from the AI Services.

Input includes any information, data, materials, text, prompts, images, works, code, or other content that you input, upload, make available (for example, by logging into your SRAM account), or submit to or through the AI Services.

The input and output may be used by other SRAM non-AI services (such as Customer Support) when prompted by you.

We have the right to (a) process the input and output as necessary to provide the AI Services; (b) use, modify, and adapt the input and output to develop, train, retrain, tune, validate, adapt, modify, enhance, or improve the AI Services and SRAM’s other products and services; and (c) use, modify, and adapt the input and output to follow up with you using other communications means (such as email).

2. What the AI Services Do NOT Do

SRAM’s AI Services do not, and cannot, replace human judgement. The AI Services do not guarantee compatibility, safety, or performance.


3. Your Responsibilities

You must comply with all laws, rules, and regulations applicable to your access and use of the AI Services and generation, use, and distribution of any output from the AI Services.
You are solely responsible for: (a) evaluating suitability of the AI Services for your intended use; (b) your use and operation of the AI Services in accordance with relevant standards, including ensuring human oversight and monitoring; (c) evaluating (including by human review) output for accuracy, completeness, and other factors relevant to your use before using, distributing, or relying on the output; and (d) your decisions, actions, and omissions in reliance or based on the output from the AI Services.

These Supplemental Terms & Conditions permit you to use the AI Services for your personal, non-commercial use only.
You agree to:

  • provide accurate and complete information in and to the AI Services, including any relevant information about your bike, and not provide any personal data;
  • only use the AI Services to suggest SRAM components for your bike and for no other purpose;
  • verify all outputs, including components suggested by the AI Services, with a qualified human technician before purchasing or installing any components; and
  • receive a summary of your interaction with the AI Services, which may include an option to rate your experience with the AI Services.

You represent, warrant, and covenant that you have and will maintain all necessary rights and permissions required to enter or submit input to or through the AI Services, including for the purposes of generating output in response to such input, so that it does not and will not infringe, misappropriate, or otherwise violate any intellectual property rights, or any privacy or other rights, of any third party or violate any applicable l aw.

You must not: (a) access or use the AI Services or any output to develop, train, or improve a competing or similar product or service; (b) use web scraping, web harvesting, web data extraction, or any other method to extract data from the AI Services or any output; (c) engage in model extraction, or otherwise attempt to derive or gain access to any source code, algorithm, model, or other underlying technology or component of the AI Services, in whole or in part; or (d) use the AI Services to create or generate output or use output in a manner that is discriminatory, offensive, harmful, or violates any applicable law.

4. Disclaimer

THE AI SERVICES AND ITS CONTENT, INCLUDING ALL OUTPUTS, ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND EITHER EXPRESSED OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND NON INFRINGEMENT.

WE DO NOT WARRANT THAT THE OPERATION OF THE AI SERVICES WILL BE UNINTERRUPTED OR ERROR FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITES OR THE SERVER THAT MAKES THE AI SERVICES AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

WE DO NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS, OR USEFULNESS OF THE AI SERVICES OR ANY SUGGESTIONS MADE BY THE AI SERVICES. YOU ACKNOWLEDGE THAT, GIVEN THE NATURE OF THE AI SERVICES AND AI TECHNOLOGY, ANY OUTPUT: (A) MAY BE INACCURATE, MISLEADING, BIASED, OR OFFENSIVE; (B) MAY BE THE SAME AS OR SIMILAR TO OUTPUT THE AI SERVICES GENERATE FOR OTHERS; (C) MAY NOT QUALIFY FOR INTELLECTUAL PROPERTY PROTECTION; AND (D) DO NOT NECESSARILY REFLECT, AND MAY BE INCONSISTENT WITH, SRAM’S AND ANY THIRD-PARTY PROVIDERS’ VIEWS.

ALWAYS VALIDATE SUGGESTED COMPONENTS PRIOR TO PURCHASING COMPONENTS OR INSTALLING COMPNENTS ON YOUR BIKE.

5. Suspension or Termination; Limitation of Liability

We reserve the right, in our sole discretion and for any reason, to terminate your access to the AI Services or any portion thereof at any time, without notice.

UNDER NO CIRCUMSTANCES, INCLUDING BUT NOT LIMITED TO NEGLIGENCE, SHALL WE BE LIABLE TO YOU OR ANY THIRD PARTY FOR DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, ARISING FROM USE OF OR INABILITY TO USE THE AI SERVICES OR ANY OUTPUT THEREOF, INCLUDING THOSE CAUSED BY ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DEFECT, DELAY IN OPERATION OF TRANSMISSION, COMPUTER VIRUS, OR LINE FAILURE IN CONNECTION WITH YOUR USE OF THE AI SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY OR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE EXCLUSIONS AND LIMITATIONS MAY OR MAY NOT APPLY TO YOU.

6. Privacy & Data

Any use of your personal data, such as your account username, is subject to our Global Privacy Policy located at https://www.sram.com/en/company/legal.

In connection with your use of the AI Services, we will only collect the information reasonably necessary to operate the AI Services. You shall not submit any personal data to the AI Services.

7. Changes to These Terms

We reserve the right to change, amend, adjust, add to or delete from these Supplemental Terms & Conditions from time to time, as necessary and, except as required by applicable law, without notice. We advise that you check back frequently to obtain updates, and you expressly agree to be bound by any such updates.
